New Cad, lost opportunity: backtracking on free software – Corcom

INTERVENTION

Sonia Montegiove, President Association Libre Italy

Someone christened CAD 3.0 him and perhaps this, as the software in their new release, it needs a “debugging” or a correction of the things that are wrong. In fact, after the approval of the first draft on 21 January, several comments were not enthusiastic and change requests.

The objective of “New CAD” should be to simplify the legislation and make it more in line with the provisions of EU Regulation 910/2014, known as eIDAS, which will come into force next July 1. In doing this, but in some respects it has been progress, for others, such as free software, it has launched the Shrimp dance. The amendment to Art. 68, which regulates the purchase of PA software forcing a comparative analysis of the solutions we should favor open source and reuse, has actually weakened it.

From this were in fact repealed the articles 2, 2 bis and 4 or references to interoperability, repertoire of open formats and prior opinion of Agid possible to ask for the PA before proceeding with the purchase of software. As for interoperability and open standards, the reference was important because, as he writes Alessandro Rubini, “a system is interoperable when you can access data or receive services from other systems, for example using” open “data formats for document management. The amendment to the CAD goes to hit the critical point for the monopolists, because in practice the Preferentiality for free software is easy to circumvent. ” In this way our CAD, who had the reputation of being among the best in Europe with preferential terms for free software and interoperability requirements for each new program that came in PA, takes shape in favor of the vendor lock-in and software.

Just at the time when you could make a choice in favor dell’openness following the example of the United Kingdom which adopted the open format ODF (Open Document Format) for all documents of the PA. Just when you could take a cue from the European Commission in 2012 has encouraged the use of open standards in the public sector by estimating a savings of one billion euro a year.

Just at the time when one could give a thrust to open source that would have allowed the PA to be independent and to do so, better choices as uncommitted. Precisely at a time when the Ministry of Defence announces the migration to free software LibreOffice proving that you can save money and reinvest in a more intelligent way public money. Just at the time when the European Parliament, in the Resolution which followed one on electronic surveillance bulk of EU citizens, supports the need for migration to open source software solutions through the introduction of a policy of modal solutions open for the benefit of those owners. Just when it might have to extend the application of the 68 also to the design and development of solutions in the broadest sense. Just when you would be able to expand the concept of open calling into question open standards.

Just at the moment when the issue of digital freedom seems to fade into the background to make room for questionable gratuity of agreements with large multinationals. Just when the sentence of a famous advertisement “The freedom of not having to choose” sounds like a dark omen.
